Do I Need To Hire An Attorney?

Updated: Nov 22, 2022

Hiring an attorney is not necessarily required to get divorced in Texas. Whether you should or should not hire one depends on your specific circumstances. A Do-It-Yourself (DIY) divorce is an option for some couples who have a less complex situation. If both parties agree that a divorce is necessary, there are no children involved, you and your spouse have a relatively low net worth, and you agree on exactly how your possessions should be divided, a DIY divorce may be a good option.

The benefit of a DIY divorce is the low cost. Most online DIY divorce services will allow you to get divorced for around $500. You will have to navigate the process by yourself without legal guidance, and there is always a risk that something may not be done properly. In the event that a mistake is made or you agree to something that ends up being unfavorable down the road, changing the divorce agreement after the divorce is finalized will be difficult or impossible in some cases.

While hiring an attorney generally has a higher upfront cost, they can end up saving you money by ensuring that you end up with your fair share of assets. They can also serve as an objective advisor during an emotional time, helping you make the best decisions possible throughout the process. In most cases, hiring an attorney will save you time as well by eliminating the need for you to learn about the process in great detail on your own.

The bottom line is that if you can afford an Attorney, it’s very likely to be a worthwhile investment, and you should obtain one as early in the process as possible.
